These terms apply to online-store orders placed through www.austcoldindustries.com.au. The seller is Austcold Industries Pty Ltd (ABN 47 162 661 752), referred to as Austcold, we, us or our.

If something goes wrong, we will work with you to understand it and provide a practical solution within a reasonable time. These commitments are explained below.
By placing an order, you agree to these terms. They do not exclude, restrict or change rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.
When you place an order, you are offering to buy the selected products or services on these terms. An automatic email acknowledging your order does not necessarily mean that we have accepted it.
We accept an order when we confirm acceptance, begin manufacturing a custom product, or dispatch the order, whichever occurs first. We may contact you to confirm measurements, specifications, availability, delivery arrangements or other details before accepting an order.
We may decline an order where a product is unavailable, payment cannot be verified, delivery is not reasonably available, or there is an obvious pricing or product-information error. If we decline an order after receiving payment, we will tell you and refund the amount paid.
You must provide complete and accurate order, contact and delivery information. If you place an order for a business or another person, you confirm that you have authority to do so.
We take reasonable care to keep product descriptions, specifications, images and prices accurate. Images are illustrative and colours or finishes may look different on different screens. Minor variations may also occur because of materials and normal manufacturing tolerances.
You are responsible for selecting a product suitable for your intended use and site conditions. If you are unsure, contact us before ordering and provide complete information about the opening, temperature, traffic, wind exposure, mounting surface and other relevant conditions. Our recommendations can only be based on the information you give us.
This section does not reduce any right you may have where a product does not match its description or where you made a purpose known to us and reasonably relied on our advice.
For supply-only products, you are responsible for checking all measurements, quantities, colours, materials and specifications before submitting the order. We manufacture custom-made, cut-to-length and configured products using the information you approve or provide.
If a product must be altered, remade or replaced because information supplied by you was incorrect or incomplete, you are responsible for the reasonable additional material, labour and freight costs. We will explain those costs before doing additional work.
This does not apply where the problem was caused by our error, our failure to follow the agreed specifications, or a failure to meet a right that cannot be excluded by law.
Prices are in Australian dollars and include GST unless we clearly state otherwise. Delivery charges and any other unavoidable charges will be shown at checkout or agreed with you before the order is accepted.
Payment must be made using a payment method offered at checkout. Unless we have approved a credit account or agreed otherwise in writing, cleared payment is required before manufacture or dispatch. Separate credit-account terms may also apply to approved account customers.
If an obvious pricing, freight or product error is discovered before supply, we will contact you. You may confirm the order at the correct price or cancel it for a full refund. We will not add an undisclosed charge after you have placed the order.
Manufacturing and dispatch times shown on the website are estimates and begin after cleared payment and all required information have been received. We will tell you if a material delay becomes known.
Contact us immediately if you need to change or cancel an order. We will help where reasonably possible, but custom production and material cutting may begin soon after an order is accepted.
If we agree to cancel or change a custom-made, cut-to-length or specially ordered product after work or purchasing has begun, we may deduct or charge the reasonable costs already incurred. These may include specially ordered or cut materials, completed labour and non-refundable freight. We will explain the amount before finalising the cancellation or change.
If we cannot supply an accepted order, we will offer a reasonable alternative, a new timeframe, or a refund for the part we cannot supply. You choose whether to accept a materially different alternative.
We may use a reputable carrier of our choice. Delivery dates are estimates, not guarantees, because carrier delays and events outside our reasonable control can occur. We will take reasonable steps to address a delay and keep you informed.
You must provide a correct delivery address and any information reasonably needed for safe access. Someone authorised to receive the goods must be available if required. Additional carrier costs caused by an incorrect address, failed delivery or unavailable access may be charged to you where those costs were reasonably incurred.
Risk in the goods passes to you when they are delivered to the nominated address or collected by you or your nominated carrier. Ownership passes when we receive full payment.
Please inspect the shipment promptly. If goods appear lost, damaged or incorrect, contact us as soon as reasonably possible and provide photographs or other information that will help us investigate. Prompt reporting helps us make a carrier claim, but it does not remove rights you have under the Australian Consumer Law.
The Australian Consumer Law does not require a business to accept a return because a customer changed their mind, ordered the wrong product or no longer needs it.
At our discretion, we may approve the return of a standard stocked product if you contact us within 14 days after delivery and the product is unused, uninstalled, complete and in resaleable condition. You must obtain approval before returning it and pay the return freight.
We may deduct a reasonable restocking and inspection charge of up to 20% of the product price. We will tell you the applicable charge before approving the return. Original delivery charges are not refundable for a change-of-mind return.
Custom-made, cut-to-length, specially ordered, altered or personalised products cannot be returned for change of mind. This section does not apply to faulty, damaged, incorrectly supplied or misdescribed products.
Our products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
If a product has a major failure, you may reject it and choose a refund or a replacement, and you may also be entitled to compensation for reasonably foreseeable loss or damage. If the failure is minor, we may choose to repair or replace the product, or provide another remedy permitted by law, within a reasonable time. If we do not remedy a minor failure within a reasonable time, you may have further rights under the Australian Consumer Law.
We may ask for reasonable proof of purchase and information needed to assess the problem. You are responsible for returning goods that can be posted or easily returned. If the product is confirmed to have a problem covered by law, we will reimburse reasonable return costs. For large, heavy or installed goods, contact us so we can arrange an appropriate assessment, collection or remedy.
A remedy is not required where the problem was caused by misuse, abnormal use, accidental damage, unauthorised alteration, failure to follow instructions, or incorrect installation by someone other than Austcold. This does not affect a claim for a separate defect or for a problem caused by us.
A product may come with an additional written warranty from Austcold or its manufacturer. Any additional warranty operates alongside, and does not replace or limit, rights under the Australian Consumer Law. Consumer-law rights may continue after an additional warranty period has ended.
The warranty document supplied with the product explains its period, coverage, claim process and exclusions. Contact us first if you need help with a product we supplied; we will not require you to deal only with the manufacturer where we are responsible for providing a remedy under the Australian Consumer Law.
For supply-only orders, you are responsible for ensuring that the opening, supporting structure, fixings, clearances, services and site conditions are safe and suitable for the product. Installation and use must follow the supplied instructions and all applicable safety and legal requirements.
We are not responsible for loss or damage caused by customer-supplied measurements, an unsuitable or defective structure, installation contrary to our instructions, misuse, impact damage, unauthorised modification, or a failure to perform required maintenance, except to the extent that we caused or contributed to the loss or the law provides otherwise.
Where Austcold has agreed to install a product, you must provide safe, clear and reasonable access to the site. We will tell you before incurring additional costs caused by undisclosed site conditions, unsafe access, delays by other trades or a site that is not ready at the agreed time.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.
To the extent permitted by law, neither party is responsible for indirect or consequential loss that was not reasonably foreseeable when the order was accepted. We are not responsible for a delay or failure caused by an event outside our reasonable control, but we will take reasonable steps to reduce its effect. If such an event prevents supply for an unreasonable period, either party may cancel the affected part of the order and we will refund amounts paid for anything not supplied.
We collect and use contact, order, delivery, account and payment-related information to respond to enquiries, process and fulfil orders, provide support, keep required business records, prevent fraud and comply with the law.
We may provide information reasonably needed to fulfil those purposes to payment providers, carriers, technology providers and other service providers involved in the transaction. We take reasonable steps to protect personal information. Contact us if you want to ask about, access or correct personal information we hold about you, or make a privacy complaint.

These terms are governed by the laws of Queensland, Australia. The parties submit to the courts that have jurisdiction under those laws, without limiting any right to bring a claim in another court or tribunal available under law.
If part of these terms is invalid or unenforceable, the remaining terms continue to apply.
We may update these terms by publishing a revised version with a new last-updated date. The terms applying to an order are those in effect when that order is accepted, unless a change is required by law or agreed with you.
